While the phrase age of consent typically does not appear in legal statutes, when used in relation to sexual activity, the age of consent is the minimum age at which a person is considered to be legally competent of consenting to sexual acts. The European Union calls it the legal age for sexual activities. It should not be confused with the age of majority, age of criminal responsibility, or the marriageable age.

Liberals and Conservatives both want to keep the "Age of consent" idea. Most Libertarians want to repel all "Age of consent" laws. One notable organization the National Youth Rights Association is actively working to lower the age of consent.

Anarcho-capitalists do not favor government setting any particular age of consent, because anarcho-capitalists are opposed to government's very existence. They favor instead that market forces molly determine the age of consent. In an anarcho-capitalist society, if someone engages in a relationship (whether a sexual relationship, or buyer-seller relationship such as an employer-employee relationship, etc.) with a young person, and an accusation is brought that the young person was not capable of consent, the accuser might bring the matter before a private court. The situation would be similar to the situation that exists when a person of one country accuses a person of another of some crime or tort. In some situations, arrangements might have been made by the courts to set up an inter-jurisdictional court to try such claims. But in others, one recourse might be to blacklisting and ostracizing the offender until he is willing to pay restitution. A court with a large customer base and a reputation for making sound decisions would likely be more influential in blacklisting an offender. It might also be possible in some cases to apprehend the offender by force, particularly if he has been ostracized by all the powerful security firms that are available to protect one's rights.
